Ministerial Conference 2016, where he said, “I strongly believe that tiger
conservation, or conservation of nature, is not a drag on development... The
Consultation Paper, in our considered view, is not in conformity with the
letter and spirit of the said statement of the Hon’ble Prime Minister.
Furthermore, it ignores the current scientific knowledge on conservation of
forests.</p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">What’s Positive</b> –
</p>
<p class="MsoNormal">The term ‘Pristine Forests’ must not be restricted to just
areas with Very Dense or Dense forests but must encompass all unique natural
ecosystems with high biodiversity values and providing refuge to endangered
species, including Protected Areas. The proposal to enhance the penal
provisions for violation of Section 2 is absolutely necessary to enhance
deterrence. However, a period of one year, in our view, is grossly
insufficient. </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">What’s missing –</b> </p>
<p class="MsoNormal">The consultation paper, regrettably, has completely missed
the most important forest conservation issue that is central to the legislation
that is under review viz. Forest fragmentation. It would therefore be
critically important to have a specific provision in the Act to curb further
fragmentation of large, contiguous forested landscapes. The CAG has found that
73% of non-forest land that had to be transferred and notified as RF / PF in
lieu of diversion of forest land had not been received. Monitoring of
conditions imposed is the weakest link in the forest clearance process. Since
most violations are clearly intentional, there is little or no scope for
rectification later. Many user agencies including Government authorities
commence work on the non-forest land portions first, and present the FAC with a
fait accompli. The Supreme Court in the Lafarge Judgment (2011) has clearly
flagged this aspect and has directed that remedial measures be put in place. We
are therefore of the opinion that these major loopholes require to be plugged
by way of specific provisions in the legislation - which are included in this
submission - and not merely by way of Guidelines. </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">What’s Retrograde</b>
– </p>
<p class="MsoNormal">The proposal to exempt lands acquired by certain agencies
for Railways, Highways etc is highly objectionable. It is a fact that the claims
of such User Agencies on Rights of Way (RoWs) in many cases are tenuous.
Therefore, such proposals may be considered de novo and, on a case-by-case
basis under the Act. The proposal of exempting Extended Reach Drilling (ERD) –
for exploration and extraction of oil and natural gas – from the purview of the
Act is extremely detrimental to forest conservation at multiple levels. The
proposal to reclassify Zoos, Safari parks, Forest training infrastructure and
delete them from the category of non-forestry activity is retrograde and must
not be considered. It is requested that the Ministry of Environment considers
these pragmatic and properly justified comments and suggestions appropriately
and ensures that the Forest (Conservation) Act, 1980 is amended to carefully
balance conservation imperatives and development aspirations.</p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">2. Opening Statement</b>
</p>
<p class="MsoNormal">The Hon’ble Prime Minister made a commitment at the Asia
Ministerial Conference 2016, where he said, “I strongly believe that tiger
conservation, or conservation of nature, is not a drag on development... All we
need is to reorient our strategy by factoring in the concerns of the tiger in
sectors where tiger conservation is not the goal...Thus, we need to define
conservation as a means to achieve development, rather than considering it to
be anti-growth”. The Consultation Paper on the proposed amendments to the
Forest (Conservation) Act, 1980 is, in our considered view, not in conformity
with the letter and spirit of the said statement of the Hon’ble Prime Minister.
Furthermore, it is devoid of the current scientific knowledge on conservation
of forests. Consequently, in our opinion, the proposed amendments will fail to
strike a reasonable balance between conservation imperatives and development
aspirations. Our pragmatic submissions are based on over three decades of active
field work on conservation of forests and wildlife, interventions on policy and
law, including our body of work on the National Board for Wildlife, and the
subcommittee on amendments to the Wildlife (Protection) Act, 1972, the Boundary
Rationalisation Committee, collaboration with State Forest Departments and site
inspection committees of the NTCA. </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3. Specific Comments
and Submissions on the Consultation Paper</b> </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.1: What’s Positive
about the proposed amendments –</b> </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.1.1:</b> The
proposal to introduce an enabling provision in the Act to keep certain pristine
forests with high ecological values intact are welcome and in line with the
objects of the law. However, two suggestions to ensure that it is further
strengthened are as follows – <i style="mso-bidi-font-style: normal;"><u><o:p></o:p></u></i></p>
<p class="MsoNormal" style="margin-left: 36pt;"><i style="mso-bidi-font-style: normal;"><u>- The clause “for a specific period” be deleted since such pristine
natural forests are national treasures and require to be protected in posterity
for future generations; and - The term ‘Pristine Forests’ must not be
restricted to just areas with Very Dense or Dense forests but must encompass
all unique natural ecosystems including grasslands, wetlands, deserts, thorn
forests etc with high biodiversity values and providing refuge to endangered
species, including Protected Areas</u></i>.</p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;"><span style="mso-spacerun: yes;"> </span>3.1.2</b>: The proposal to enhance the penal
provisions for violation of Section 2 is absolutely necessary to enhance
deterrence. However, a period of one year, in our view, is grossly insufficient<i style="mso-bidi-font-style: normal;"><u>. </u></i>We therefore suggest the
following –<i style="mso-bidi-font-style: normal;"><u><o:p></o:p></u></i></p>
<p class="MsoNormal" style="margin-left: 36pt; text-indent: 1.5pt;"><i style="mso-bidi-font-style: normal;"><u>- That the term of imprisonment for any
person who contravenes or abets the contravention of Section 2 must exceed two
years and also with fine which shall not be less than five Lakh rupees. Apart
from increased deterrence, this will ensure that the procedure applicable for
warrant cases under the Code of Criminal Procedure, 1973, will apply. As
correctly stated in the Consultation Paper, the offence must be classified as
Cognizable and Non-bailable. Further a proviso may be added to clarify that if
a public servant is alleged to have committed or abetted the commitment of an
offence, prior sanction of the Government to prosecute would not be necessary.<o:p></o:p></u></i></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal"><span style="mso-spacerun: yes;"> </span><b style="mso-bidi-font-weight: normal;">3.2: What’s missing from the proposed amendments</b> – </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.2.1: Forest
Fragmentation or Honeycombing</b>: </p>
<p class="MsoNormal">The consultation paper, regrettably, has completely missed
the most important forest conservation issue that is central to the legislation
that is under review viz. Forest fragmentation, which is the breaking up of
large blocks of forests into smaller patches due to ill-planned intrusion of
developmental projects. Scientists of the <b style="mso-bidi-font-weight: normal;">National
Remote Sensing Centre (NRSC),</b> in a published peer reviewed scientific paper
titled - <b style="mso-bidi-font-weight: normal;">National assessment of forest
fragmentation in India</b>, have concluded that <i style="mso-bidi-font-style: normal;"><u>- “Fragmentation is one of the single most important factors leading
to the loss of bio-diversity in forest landscapes… The analysis revealed that
in all bio geographic zones, more than 90% of total number of forest fragments
consists of patches having area less than 1 km2…. The decreased mean patch
size, increased edge density and increased number of patches from 1975 to 2005
indicates ongoing fragmentation in bio geographic zones. The very high
fragmentation in Trans Himalayas is contributed mostly by the natural factors
while in other bio geographic zones, increased fragmentation is due to
deforestation…The results are advocating the need for rational management of
the forest cover of India”</u></i>. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">It would therefore be critically important to have a
specific provision in the Act to curb further fragmentation of large,
contiguous forested landscapes applying the principle of avoidance. Further,
clearance for forest land only for those site-specific project components
–while diverting all other components to areas outside forests E.g. Components
of a Mining Project viz. Site-specific - Ore body; Non-site specific -
Beneficiation/Pellet Plant, Township; will greatly minimize the impact of
fragmentation and loss of natural forests. </p>
<p class="MsoNormal">This is crucial for keeping natural landscapes intact, which
is necessary to mitigate the impact of climate change and for securing wildlife
corridors. Based on the findings of the Government’s own scientific agency, and
in order to ensure a pragmatic balance between conservation and development, we
suggest the inclusion of the following provision in the Act – </p>
<p class="MsoNormal" style="margin-left: 36pt;"><i style="mso-bidi-font-style: normal;"><u>Section 2 (iii) that any proposal for diversion of forest land
amidst large forest blocks or forming part of a contiguous forested landscape,
or both - irrespective of the extent of the area sought – shall ordinarily not
be considered.</u></i> </p>
<p class="MsoNormal" style="margin-left: 36pt;"><i style="mso-bidi-font-style: normal;">Provided that in small, scattered pockets of forests that do not form
part of a Protected Area or contiguous forested landscape connecting two or
more Reserved Forests, or an important wildlife niche or wetland, General
Approval may be considered for critical development and public utility projects
proposals, excluding mining and encroachment regularisation, based on
appropriate Guidelines that incorporate due safeguards and mitigation measures</i>.</p>
<p class="MsoNormal"><span style="mso-spacerun: yes;"> </span><b style="mso-bidi-font-weight: normal;">3.2.2.</b> The CAG in their Audit Report No. 21 of 2013 had found that
over 75,000 ha of non-forest land that User Agencies had to mutate and transfer
to the Forest Department in order to secure Stage II clearance had not been
received. This amounted to a staggering 73% of non-forest land that had to be
transferred and notified as RF / PF in lieu of diversion of forest land. This
is thus a major loophole in the Guidelines that requires to be plugged by
legislation. The transfer or mutation of non-forest land immediately adjacent
to RFs/PFs and/or within enclosures of RFs or PAs/Tiger Reserves or buffers or
in areas forming important wildlife corridors can significantly contribute to
consolidation of forests, which will in turn mitigate the impact of
fragmentation and ensure Afforestation in such buffer areas which will be of
greater value than in scattered parcels of land. It is therefore our view that
this loophole must be decisively plugged by inclusion of the following new
section which could be in the following form –</p>
<p class="MsoNormal" style="margin-left: 36pt;"><u>- <i style="mso-bidi-font-style: normal;">2A. Transfer and Mutation of non-forest land. – Notwithstanding
anything contained elsewhere in this Act, the User Agency shall transfer and
mutate suitable non-forest land, immediately adjacent to RFs/PFs or within
enclosures of RFs or Protected Areas or, in Buffer Areas of Tiger Reserves or
wildlife corridors, identified and included in the Land Bank prepared by the
State Forest Department, before grant of Stage II clearance.</i> <o:p></o:p></u></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.2.3:</b> <b style="mso-bidi-font-weight: normal;">Monitoring mechanism</b>: </p>
<p class="MsoNormal">Monitoring of conditions imposed is the weakest link in the
forest clearance process. The loopholes in the current regime - including the
current on-line forest clearance system - give ample scope for exploitation by
unscrupulous project proponents in collusion with authorities involved. Since
most violations are clearly intentional, there is little or no scope for
rectification later without timely detection, as is the situation now. This
forecloses the option of preventing the destruction of forests, which is the
primary object of this legislation</p>
<p class="MsoNormal">It is therefore our view that this important regulation must
<b style="mso-bidi-font-weight: normal;">be included in the Act and not merely in
the Guidelines. </b>This, in conjunction with the proposed increase in
penalties, will further increase deterrence and contribute to prevention of
forest destruction. </p>
<p class="MsoNormal">We therefore suggest that this important lacuna is
appropriately addressed by the introduction of a new section which could be in
the following form – -</p>
<p class="MsoNormal" style="margin-left: 36pt; text-indent: 1.5pt;"><b style="mso-bidi-font-weight: normal;"><i style="mso-bidi-font-style: normal;">2B.
Monitoring of Projects</i></b>. - <i style="mso-bidi-font-style: normal;">Any
non-forestry activity approved under Section 2 shall be monitored throughout
the validity of the period for which the approval has been granted, by the
Deputy Conservator of Forests having jurisdiction over the area along with the
Regional Empowered Committee.<o:p></o:p></i></p>
<p class="MsoNormal"><i style="mso-bidi-font-style: normal;"><span style="mso-spacerun: yes;"> </span></i><b style="mso-bidi-font-weight: normal;">Explanation.</b>
- For the purposes of this section, “<u>monitoring” means site inspection of
the project area at the time of commencement or breaking up of forest land, and
during all key identified project milestones set forth in the approval, and
annually including randomly at any time, if complaints of violations are
received.</u> </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.2.4 Preventing <i style="mso-bidi-font-style: normal;">Fait accompli</i> situations:</b> </p>
<p class="MsoNormal">Where portions of forest and non-forest land are involved in
a project, many user agencies including Government authorities / PSUs deviously
commence work on the non-forest land portions first, and present the FAC with a
fait accompli. Citing the investments made, they then seek – and usually
receive - ex-post facto clearances. Many agencies are even using this as a
clever strategy by splitting up projects to secure clearances that otherwise would
not have been possible. This is particularly true in cases of linear intrusions
like highways, power lines etc. The Supreme Court in the Lafarge Judgment
(2011) has clearly flagged this aspect and has directed that remedial measures
be put in place.</p>
<p class="MsoNormal"><span style="mso-spacerun: yes;"> </span><u>We are therefore
of the opinion that this major loophole requires to be plugged by way of a
specific provision in the legislation and not merely by way of Guidelines</u>.
In this view of the matter, we suggest that the following section be included
in the Act –</p>
<p class="MsoNormal"><span style="mso-spacerun: yes;"> </span><b style="mso-bidi-font-weight: normal;">- 2C. Regulation on Ex-post facto Clearances</b>. – </p>
<p class="MsoNormal" style="margin-left: 36pt;">(1) Every user agency shall
ensure, in cases where projects involve forest as well as non-forest land,
which work shall not commence on non-forest land till approval of the Central
Government for release of forest land under Section 2 has been obtained. – </p>
<p class="MsoNormal" style="margin-left: 36pt;">(2) Proposal seeking ex-post
facto clearance shall not be considered and approval shall not be granted
unless the Central Government being satisfied, in consultation with the Forest
Advisory Committee, only in exceptional cases, <u>after charging NPV at the
highest applicable rate, for the entire extent of non-forest land as well,
where work was carried out, grant clearance on a one-time basis only in respect
of the User Agency</u>. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">Explanation. –</b>
For the purposes of this section – (a) “Ex-post facto clearance” means
clearance under Section 2 for diversion of forest land, after commencement of
work on non-forest land by splitting or bifurcation of a project or otherwise.
(b) “One -time basis” means one single consideration in respect of the User
Agency or Government Department for the first offence only. </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.3: What’s
Retrograde in the proposed amendments</b> – </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.3.1</b> The
proposal to exempt lands acquired by certain agencies for Railways, Highways
etc is highly objectionable. Fundamentally, this proposal forecloses the
application of several principles prescribed by the current legal regime
including landmark Judgments of the Hon’ble Supreme Court which include payment
of Net Present Value, appraisal of the proposal in terms of site specificity,
prescription of the principle of avoidance of linear intrusions as a primary
criterion, and evaluation of feasible alternative alignments etc. It is a fact
that the claims of such User Agencies on Rights of Way (RoWs) in many cases are
tenuous to say the least and may not be supported by proper documentation and
records. This has the potential of creating legal complications with
conflicting claims of ownership, and, consequently, prolonged litigation. <u>Therefore,
the proposals, if any, moved by such User Agencies may be considered de novo
and on a case-by-case basis under the Act. We therefore submit that the
proposal to exempt lands acquired by certain agencies for Railways, Highways
etc deserves to be completely excluded. <o:p></o:p></u></p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.3.2</b> The
proposal of exempting Extended Reach Drilling (ERD) for exploration and
extraction of oil and natural gas from the purview of the Act is extremely
detrimental to forest conservation at multiple levels. When seen in conjunction
with the proposal to exempt survey and investigation from the regulations
contained in the Act, this proposal can have cascading negative impacts. Riding
on these exemptions, several ancillary non-forest activities like roads, power
lines, pipe lines etc will piggy back on the exempted activity, with
potentially serious consequences. When such ERD technologies are not even being
insisted upon for laying of HV DC Power Cables, OFCs etc, it would not be
appropriate to keep ERD outside the purview of the Act. <u>We are therefore of
the clear view that this proposal must be completely removed and should not be
considered.</u> </p>
<p class="MsoNormal"><b style="mso-bidi-font-weight: normal;">3.3.3</b> <u>The
proposal to re-classify Zoos, Safari parks, Forest training infrastructure and
delete them from the category of non-forestry activity is retrograde</u>. If
this is permitted, the demand to include other activity likes Elephant Camps,
Eco-tourism infrastructure; visitor centres etc will surely follow. Therefore,
Zoos, Safari parks and Forest training infrastructure must continue to be

We are also very much concerned that the move is an ill executed and done in a completely unscientific and haphazard manner, probably wasting public resources on an ill conceived scheme.</div><div><br /></div><div><br /></div><div>Grounds:</div><div><br /></div><div>A large part of the area where tree saplings are now planted is an ecologically degraded land area – which was degraded in the first place by mowing down the largely undisturbed patch of natural tree cover ,for the metro casting yard.</div><div><br /></div><div>This calls for an approach applying the principles of ecological restoration.</div><div><br /></div><div>We are very much concerned that a large area of the land is planted with teak saplings in a monoculture plantation fashion.</div><div><br /></div><div> This is a completely ill thought out move-so to say. We tried to talk to the senior Officials of both HMT limited, and the Social forestry Division, Ernakulam, and expressed our concern over the manner in which the tree planting is being done and especially the decision to plant teak trees in a monoculture plantation mode. The reason expressed by these officials is that it will economically benefit for HMT Ltd., as and when the plantation can be cut and sold.</div><div><br /></div><div>Teak is a notoriously water guzzling tree species - even more so than the eucalyptus and wattle .</div><div><br /></div><div><span style="white-space: pre;"> </span></div><div><br /></div><div>Teak plantation depletes the ground water table of this area, thereby affecting the water security and livelihood of the people of the surrounding area.</div><div><br /></div><div>The argument that it will economically benefit the HMT ltd, is also a fallacy as it will take 50-60 year for trees to grow large enough to be economically beneficial, by the time which, the plantation will have depleted enough ground water to cause serious damage to the environment.This is unpardonable as we all are facing mass extinctions, unprecedented floods and droughts and many other ecological and environmental catastrophes ,in the face of which we cannot bring more damages to the environment, by our thoughtless actions.</div><div><br /></div><div><br /></div><div>One more thing is that the teak tree plantations suck up all nutrients from the soil so much that the area planted will be barren and damaged ecologically beyond repair, whereby other trees and plants won't be able to grow healthy.</div><div><br /></div><div>Another thing we noticed is that the saplings already planted are of inferior quality apparently ,as they are already showing signs of wilting.</div><div><br /></div><div><br /></div><div>Therefore we propose that ,</div><div><br /></div><div>The unscientific tree planting drive be stopped forthwith.</div><div><br /></div><div>The services of ecological restoration experts in planting of the trees may be obtained.</div><div><br /></div><div>The trees suitable for the elevation, agro climate conditions, soil nature,and the ecological niche be selected as per the advice of the experts.</div><div><br /></div><div>Principles such as associated species and complementary species be observed while planting is done.</div><div><br /></div><div>Indigenous, threatened and endemic species suitable for are may be selected for planting.</div><div><br /></div><div>Ideas like the Mixed Species Forest Plantation may be explored as per the advice of the experts.</div><div><br /></div><div>The planting may be done as per the advice of the experts keeping the mixed tree species planting concept. The 13th KERALA Bird Race will be held on Sunday, 01st December 2019.<br />
<br />
The Hong Kong and Shanghai Banking Corporation Limited (HSBC), along with Kerala Birder, Cochin Natural History Society, Kerala Agricultural University along with Kerala’s birding community, are organizing this unique programme in and around the city. The all-India coordinator for the India BirdRAces is The Yuhina Canopy, while UWM is the Facilitating Partner.<br />

As more of us people come into the urban world, we are not only shrinking natural landscapes immediately around our expanding urban centers but also our impacts on nearby wildernesses is escalating as well.<br />
<br />
The India BirdRaces are a popular, non-competitive program for the joy of birding, that serves to bring together all the birding enthusiasts, from rank beginners to experts and professionals, as well as NGOs, birding groups, city administrations, forest and wildlife personnel and others in every city it is organized. This exciting program is conceptualized to help look at the avifauna (birdlife) of our urban and their surrounding wealth of habitats and serve to popularize bird-watching and help lead to a better understanding of other aspects of our biodiversity and environment.<br />
<br />
After all, birds are often the foremost attraction for anyone interested in exploring the natural world. Birds are often also the most visible and moving indicator for changes happening around us, changes influenced by our actions. The BirdRaces help document many sites around every venue, up to an area of at least 40 – 50 km from the radius of every urban area, and we get a trend of what is increasing or retreating or disappearing.<br />
These BirdRaces are simple, enjoyable and interactiv events, beginning from dawn and ending at an interactive get-together at a prominent venue, over dinner and chats and presentations and sharing of thoughts and lots more.<br />
There is a Bird-of-the-Day team prize this year.<br />
The evening Meet-Up of the program this year will be at The Surya Luxury Hotel, Near Kochi Intl. Airport, Railway Stn. Road, Angamaly.<br />

The Chief Guest of the Function is <b>Sri. S Unnikrishnan(IFS), Deputy Conservator of Forests, Kerala Forest Department .</b><br />

There will be a screening of the documentaries <b>The Urban Canopy(Dir: Sujith M G)</b> on the importance of our vanishing urban biodiversity of Kochi city and <b>White Cloud(Dir: Mahesh Maanas)</b> both by the Green Grace Trust followed by Dinner.<br />
<br />
With nearly 3000 people collectively partaking across more than a dozen Indian cities between November and March, the India BirdRaces are possibly the greatest birding event.<br />
Invaluable data has been gathered to this fun event that is no less serious than science.<br />
A day well spent for the cause of birds and urban environment!<br />

Wetlands in an agriculture-dominated landscape are known to support high bird diversity. Besides supporting bird populations these wetlands also provide ecosystem services in the form of cattle grazing, harvest of multiple wetland products (e.g., reeds, fish, silt, etc.), and water for agricultural and domestic purposes. These wetlands support non-breeding as well as breeding populations of water birds, including those that form heronries.Heronry birds are flagship species and good indicators of the health of the wetland ecosystem (Kushlan 1993; Frederick et al. 2009). Monitoring of heronry birds, hence, is useful in understanding the impact of pollution on the wetlands of agriculture-dominated landscapes and patterns off climate. The simple aim of the Heronries Census is to collect counts of 'apparently occupied nests' (aon) of herons, egrets and other colonial waterbirds from as many heronries as possible each year.<br />
<br />
Many heronries hold a dozen or more nesting pairs, even a hundred or more, and occupy traditional, well-known sites that are active for many decades. Smaller and shorter-lived heronries must also be included in the counts, however, to ensure that the data represent the whole population. Even single nests of any of the normally colonial heron or egret species are relevant to the Heronries Census, even if only occupied for one season.<br />
<br />
Changes in the numbers of nests over time are a clear measure of population trends. The more heronries that can be counted each year, the more certain we can be of population trends at national, regional and local scales.<br />
<br />
Some of the traditional Heronries in Ernakulam District have been identified. But many more remain undiscovered.Therefore we need to make an all out effort to locate and identify as much as Heronries and we need as many volunteers to help us in this effort.<br />
So please come to Mangalavanam on Saturday 11th May 2019 for a detailed discussion and planning.<br />

In this time of severe, all around loss of biodiversity and the climate change, it is imperative that we try to preserve whatever habitat and , life birds such as waterbirds and herons who provide enormous ecosystem services to the community.<br />
<br />
With an aim to do something in this direction we intend to conduct the survey of Heronries in Ernakulam district this year onward.<br />
Towards this end a preliminary meeting is proposed to be held at 5 pm, at Mangalavanam Bird Sanctuary (behind Kerala Highcourt) on Satureday 13th April 2019.<br />
<br />
All nature enthusiasts and in fact anybody with interest and are willing willing to volunteer for this survey are ivited to participate in the meeting wherein more information and rationale will be shared and the strategy to achieve this objective will be discussed.<br />

At the outset, we wish to thank you and the company for maintaining excellent green cover in your Kalamassery estate which comprise of diverse habitats like evergreen forests, shrub forests, grass lands, wetlands etc. Because of such a nature friendly eco system maintained by the company around 200 species of birds have been recorded by researchers and bird watchers from Kalamassery .The area is also rich in other flora and fauna. This green cover coupled with wet lands has also protected the water table of Kalamassery from going down and in fact there are wells in Kalamassery which supply drinking water to Cochin City. This has also helped in maintaining a lower atmospheric temperature level in Kalamassery.The Kerala Forest Department has also recognized the bird diversity of Kalamasssery by releasing a poster ) mentioning 191 species of birds, including many endangered species.<br />

In this context, we note with concern that some areas of the estate has been let out for film shooting and the people working for putting up sets for the film are doing so with total disregard for environment, cutting down full grown trees, using road rollers to level the terrain, where many tree dwelling and ground feeding birds are active. As per Indian Wild life protection act 1972 most of the birds are listed in under scheduled category and any offence towards listed species, habitat and nest is considered as hunting and punishable even if it occurs in a private land. It is the duty of citizens to bring to the notice of authorities any violation. However when some of our volunteers tried to point out the damage to the workers there, the retort was that they will fire crackers to drive the birds away or light fires and our volunteers cannot question.<br />

Further there has been many wild fires in HMT Estate in recent time necessitating intervention of Fire force and people have to exercise caution while working there. However these film set workers have been smoking recklessly and also using electric cutting tools with sparks flying.<br />

<br />
We also understand that these particular film unit has come to your company after they were denied permission by Forest Department in another area.<br />
<br />
<br />
<br />
In view of the above we request your good selves to prevail upon these film people to exercise restraint and to be cautious in working this bio diversity hot point.<br />

The <b>HSBC Kerala Bird Race 2018</b> was held in Kochi and surrounding areas on 30th December 2018.Birdwatchers and Nature enthusiasts from Ernakulam, Thrissur, Alappuzha, Malappuram, Idukki and even Tamilnadu actively took part in the annual event which is in its 12th year running. This year a total of<b> 247</b> species of birds were recorded as opposed to 200 species last year.<b>10740</b> individual birds were encountered as opposed to 5920 last year.</div>

The birds sighted include 14 species of raptors (Greater Spotted Eagle, Rufous Bellied Eagle, Crested Goshawk, Crested Honey Buzzard etc.,) 7 species of woodpeckers including Greater Flameback. Largest number of a species sighted was 1000 Lesser Whistling Duck.</div>

It is time for another rendezvous with birds of and around urban India!<br />
<br />
The 12th Kerala Bird Race will be held in Kochi on Sunday, 30th December 2018.<br />
<br />
The <span style="color: #0b5394;"><b>Hongkong and Shanghai Banking Corporation Limited (HSBC</b><b>)</b></span>, along with Kerala’s enthusiastic birding community (<b><span style="color: #38761d;">Cochin Natural History Society,Centre For Wildlife Studies, Kerala Agricutural University, Kole Birders </span></b>and many others), are organizing this unique programme in and around the city. The all-India coordinator for the India BirdRaces is <b><span style="color: #274e13;">The Yuhina Canopy</span></b>, while <b><span style="color: #274e13;">UWM</span></b> is the Facilitating Partner.<br />

In an interesting development this year, we have <b>eBird India</b> as well as <b>Bird Count India</b> as the partners to share knowledge and help promote a love and appreciation for observing birds in an organized manner.<br />
<br />
Also, this year, participants and/or teams have the option of doing a half day bird-watch up to about 1 pm or lunch break, and then come refreshed for the evening get-together.<br />
<br />
In an increasingly urbanizing world, with more and more people residing in urban areas, these human-influenced landscapes of town and city and their immediately impacted surroundings have become another habitat. Birds are often the foremost attraction for anyone interested in exploring the natural world.<br />
<br />
The <b>India BirdRaces </b>have been conceptualized to help look at the avifauna (bird life) of these urban areas and their surrounding wealth of habitats and serve to popularize bird-watching and help lead to a better understanding of other aspects of our biodiversity and environment.<br />
Simple, enjoyable and interactive, these dawn to dusk events allow teams of birding enthusiasts spend a day birding in and around a city, up to 50 km or so around the urban perimeters.<br />
This is followed by an exciting, interactive evening get-together where all participants, from children to rank beginners get an opportunity to interact with some of the finest and most experienced birders in that city, including special invitees. There is a Bird-of-the-Day team prize. . With nearly 3000 people collectively partaking across more than a dozen Indian cities between December and early-March, the India BirdRaces are possibly the greatest birding event.<br />
<br />
In recent years, the India BirdRaces have become a Non-Competitive event, with no winning teams based on tallies, but yet the event has been retained as a Race to try spot as many birds and explore every site in and around a city. Invaluable data has been gathered and which reflects all that is good and bad about how our urban areas are impacting the natural scheme of things.<br />
Despite its rules, there is a fun element to this exercise, as also the team spirit and participation that comes into focus here. A day well spent for the cause of birds and urban environment!<br />

All people with interest in Nature are encouraged to participate.<br />
There will be a briefing Session at 5pm on 28th December 2018 for the event at <span style="color: #38761d;"> <a href="https://goo.gl/maps/vMaowX39rWH2" target="_blank"><b>Mangalavanam Bird Sanctuary</b></a></span> for the participants.<br />

World Wetlands Day is celebrated on 2nd February each year. It marks the day of adoption of RAMSAR Convention for the conservation of Wetlands in the Iranian City of RAMSAR on this day.</div>

Wetlands defined as areas of land that are either temporarily or permanently covered by water exhibit enormous diversity according to their genesis, geographical location, water regime and chemistry. Wetlands are one of the most productive ecosystems and play crucial role in hydrological cycle. Utility wise, wetlands directly and indirectly support millions of people in providing services such as storm and flood control, clean water supply, food, fiber and raw materials, scenic beauty, educational and recreational benefits.(National Wetland Atlas Kerala 2010).</div>

Under the text of the RAMSAR Convention (Article 1.1) wetlands are defined as: “areas of marsh, fen, peatland or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish or salt, including areas of marine water the depth of which at low tide does not exceed six meters”. In addition, the Convention (Article 2.1) provides that wetlands: “may incorporate riparian and coastal zones adjacent to the wetlands, and islands or bodies of marine water deeper than six meters at low tide lying within the wetlands”.</div>

In October 2018 in Dubai, during the 13th meeting of the Conference of the Parties to the Ramsar Convention on Wetlands, we will be recognizing the first cities to obtain Wetland City Accreditation under our Convention.</div>

<b>The 11th Kerala Bird Race was held on 26th November 2017 in Kochi in Kerala. 164 birdwatchers and nature enthusiast from Ernakulam, Thrissur Alappuzha, Kottayam and Idukki participated in the birding programme which is held annually commensurate with the birthday of Dr.Sa`lim Ali, Doyen of Indian Ornithology. The Kerala Bird Race is supported by HSBC Bank, Yuhina Canopy and UWM, Mumbai.This year Birdwatchers from Jammu& Kashmir and Colorado, United States also participated. So it was an almost global event, cosmopolitan in character with people from all walks of life participating in the programme. School and College Students, Housewives, Advocates, Engineers, Software professionals, Doctors, Retired Scientists, Wildlife Photographers all enthusiastically took part in the programme. We are in the midst of the migratory birding season and now we can see many winged beauties in monochromes, duo tones and multi color- vibgyor , both ocurring throughout the year in our state and those who come to visit and enthrall us with the myriad hues and huge repertoire of songs from other parts of the globe during this time of the year.It is in this background that the <b>Kerala Bird Race 2017</b> is happening on <b>Sunday, 26th November</b> in its eleventh iteration.Birds always fascinate and intrigue us with their colors shapes ,songs,calls and their jizz...which can move the hearts of even driest of the humans....<br />

<b>The Bird Race</b> with its fun element is the perfect reason and time to observe and enjoy these beauties in the company of our friends, family or expert birders .The Bird Race -though it has competitive tone in it- (but) is not a race in truest sense yet encourages us to push our limits to watch, listen to , experience and record as many and as much as birds during the course of a day. After a hectic day of birding in the surrounding areas of Kochi city and outskirts- up to 50 kms. radius- we meet at a suitable place to share our experiences of the day, cross check and collate our sightings, determine which of the commonest birds we missed; which of the rarest ones, we were lucky to spot etc., with our fellow travelers .This is followed by the interaction with invited dignitaries and Dinner.Thus the Bird Race ends..<br />

All the above quotes are by the famed American environmental writer, Edward Abbey. The reason he and his memories came alive IS because of Dr. A. Latha, who passed away this morning (16-11-2017). For those who knew her intimately no words could measure their deep feeling of loss. She has articulated her convictions and emotions rather bluntly than choosing to be diplomatic. Rational foundations of her arguments would have escaped the eyes of the naive and by those who refused to look beyond their preconceptions. Like Abbey, Dr.Latha was a true patriot, a champion of nature and wilderness, environmental frugality, one who believed and lived to show that that it is possible to have a value system deep-rooted in the ethics and economy of nature.</div>

She started off as a student of biology, earned an advance research degree in agricultural sciences, worked with state agricultural department and never ceased to be a student of nature. But the Philosophiæ Naturalis that she imbibed was not the one of Newton’s. Moving closely with a small but influential and significant group of naturalists who had informed the nature of environmental consciousness in Kerala and elsewhere, she had decided to rededicate herself in defence of nature. S.Unnikrishnan, a poet-hearted mechanical engineer who returned home from metropolis has given her company. It was her deep rooted selfless conviction that powered her articulations, made them influential among the youngsters. Gradually, a small collective of people who are interested in studying water, river, continuity of life around it formed and the River Research Centre (RRC) was born. Like Arne Næss, the deep ecologist who defined a watershed as the ultimate nation we live in, Dr.Latha and team had understood rightly that only a river basin is the nearest approximation the life supporting system of earth. They belived that all other boundaries would only invoke ecological externalities leading to incalculable ecological and social costs.</div>

All the works that the team taken up preceded meticulous collation of data and information which were put into right perspective- the ecological wisdom (which many of us who are schooled for the worldly would not subscribe to). It is evident in all the major arguments put forth in all the three books she had (co-)authored. RRC gradually accumulated an impressive collection of information, data and documents which formed the basis for building arguments in support of Environmental Flow and continued protection of forested catchments. The idea of conservation was thus not merely about conservation and planting of a few trees but a whole universe of life support system which included people as well. That is the story of building arguments in support of Chalakkudy River and people in both downstream as well as upstream, campaigns against the proposed hydro Electric project, defending the Gadgil Committee report, movement to restore the first if not second irrigation project in Kerala (the Thumboor Moozhi weir and irrigation system).</div>

The Thumboor Muzhi weir and its associated canal network were conceived and partially built even before the formation of Kerala state, for augmenting the rice paddy cultivation by irrigating about 196.90 sq. km of land in Aluva, Mukundapuram and Kunnathunadu Taluks. In the post-independence decades, due to scramble for boosting ‘industriousness’ in the state and for increased power generation, a series of inter-basin diversion projects came up in the Chalakkudy River diverting water and thus altering the flow regime in the river. Beginning with Parambikkulam Aliyar Project down to the Poringalkuthu there are two major inter-basin diversions and more than five dams in the Chalakkudy River on the upstream of Thumboor Moozhi Weir adversely impacting the flow regime of the river and water availability in the irrigation canals. The irrigation canals including the branch canals had a total length of about 400 kms! After 1980s, due to the power generation projects, interbasin diversions, peak load power production controls, the water starved Thumboormuzhi irrigation project could not deliver promised amount of water to the tail end. Gradually, canals were dried up for decades. Canal land was encroached up on, and filled in some cases beyond recognition. Food crop cultivation in the command area shifted to commercial cultivation not requiring irrigation. Dr.Latha and team could clearly perceive the state ideology, the love for mega projects, the crave for more power generation beyond the requirement of subsistence to cater the capitalist interest at the cost of small viable irrigation projects catering the needs of small holder farmers. So a ‘Bhageeratha’ effort was began. A team of young, dedicated, evergreen enthusiasts started gathering information on the irrigation scheme, unrelentingly, unyieldingly talking to land grabbers, Panchayat members, uninteresting and often stubborn, megalomaniac government officers, engineers who think they know best...400 km of canal net work...tracing the decision makers at the peak load control station, reverting back to KSEB top brasses to change their priority. Two years of campaign, water reached tail end of one canal after more than three decades !</div>

That was a moment of great joy and celebration. Many from across India arrived to take part in the meeting that was held in a noisy, small, bare hall in the Chalakkudy town. Dr. Paul Appasamy, Engineer trained at US, expert in water resources, earlier director and professor at the Madras Institute of Development Studies and Madras School of Economics had earnestly listened to Ravi’s and Rajaneesh’s presentations and commented that ‘power generation schemes at the cost of an irrigation scheme- this would not happen in Tamil Nadu’. The reason he said was that in Tamil Nadu, when two farmers meet they invariably ask if everything is fine with vyavasaya?-referring to the agriculture. Were as in Kerala agriculture is not vyavasaya (industriousness). For us Keralites vyavasaya means factories and boilers, production line, raw material docks and mining. Paul Appasamy’s comment captured the essence of the work and perspectives of the Latha and team. The effort was truly at par with the legendary ‘Bhageeratha’s’ effort. And the perspective, Against the Grain- the dominant ideology.</div>

Thumboor Muzhy is just one instance. Many small and large campaigns... All supported by sufficient data, maps and information, passion and emotion. Though some who hold a different perspective about the meaning of life and different idea of future but less knowledgeable about the ecological net that support our present may disagree. There are many truths in the world; Some backed by greed, arrogance of power and devices of state centric education catering the imbalanced accumulation of capital; yet another flowing gently, lovingly and caringly all the world that is around us. For Dr. Latha, a caring, quick, witty, bold and gentle, uncompromising lover of web of life the truth meant the latter. </div>
